Within the scope of this Privacy Notice 42DM determines why and how the processing of your Personal Data should take place. It means that 42DM is (i) a Data Controller under the EU General Data Protection Regulation (“GDPR”) and UK GDPR; (ii) and a Business under the California Consumer Privacy Act (“CCPA”) (if applicable).

When we provide our professional services to business clients we may process Personal Data of our clients’ customers or potential customers. In such cases 42DM processes the Personal Data on behalf of its clients and according to their instructions. Under the GDPR 42DM acts as a Data Processor and as a Service Provider under the CCPA. 

Please note that this Privacy Notice does not cover our processing of Personal Data as a Data Processor.

Personal Data you give us personally

  • Contact Data: your first and last name, email address, phone number (if applicable), name of the company you represent, and your role at the company.

As an EU or UK resident, under GDPR and UK GDPR you have the following rights:

  • Right of access: You have the right to ask us for copies of your Personal Data;
  • Right to rectification: You have the right to ask us to rectify Personal Data you think is inaccurate. You also have the right to ask us to complete Personal Data you think is incomplete;
  • Right to erasure (right to “be forgotten”): You have the right to have all of your Personal Data erased when you stop using the Services and close your account;
  • Right to restriction of the processing: You have the right to ask us to restrict the processing of your Personal Data in certain circumstances;

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

As a California resident, under CCPA you have the following rights:

You have a right to request disclosure of your Personal Data, and to receive additional details regarding the Personal Data the Company collects and its use purposes, including any third parties with which it shares Personal Data. You have a right to request a copy of your Personal Data that the Company has collected about you during the past 12 months in a readily usable format. You can exercise this right only twice in 12 months.
  • Right to deletion. You can ask us to delete the Personal Data that we have collected about you.
  • Right not to be subject to discrimination for the exercise of rights. You are entitled to exercise the rights described above free from discrimination. This means that we will not take any actions such as denying you services, increasing the price/rate of services, decreasing service quality, or suggesting that we may penalize you as described above for exercising your rights.
  • Opt-out right for Personal Data Sales. You have a right to request to opt out of the sale of Personal Data to third parties.

 
You are not required to pay any charge for exercising your rights. If you make a request, we have 45 days to comply with your request. Please note that to comply with your request we will need to confirm your California residency.

CHILDREN’S PRIVACY

We do not intentionally or knowingly collect Personal Data from children under the age of 16 and our services are not targeted at children. If you are under 16, please do not send any data about yourself to us, including your name, address, telephone number, or email address. No one under the age of 16 may provide any Personal Data. If we learn that we have collected Personal Data about a child under the age of 16, we will delete that data as quickly as possible. If you believe that we might have any data from or about a child under the age of 16, please contact us.

We restrict access to your Personal Data to those employees and vendors who need to know that information to provide the Website to you and communicate with you at your request. 42DM is a U.S. company and your Personal Data is mainly stored in the United States. We need to inform you that the governments, courts or law enforcement, or regulatory agencies of the United States may be able to obtain disclosure of your Personal Data through a lawful order.
